DACA the disaster, as I like to call it, finally made it’s way up the Supreme Court. Fully known as the Deferred Action for Childhood Arrivals (DACA), it has disrupted the lives of millions of people, including 699,350, now mostly young adults, who were brought illegally into the United States.
The Supreme Court ruled last Thursday against the Trump administration’s effort to end DACA, affirming that the administration’s decision violated the Administrative Procedure Act [APA], which set out rulemaking procedures for federal agencies.
Where did DACA originate from and is it law?
Even with Democratic majorities in both houses of the US Congress, former President Obama could not get an immigration bill passed and signed into law. In many speeches addressing the left’s failure to pass the reforms, Obama chastised those upset at him reminding them the Constitution did not give him the authority to arbitrarily write immigration law.
After 6 years of trying, and with a Republican majority in the House of Representatives, President Obama changed course on his authority to act. Using the Executive Order authority given to a President, he wrote DACA, which in effect established a new immigration law, by preventing the existing laws from being enforced.
First, the senior administration official said, the executive branch is given “prosecutorial discretion” by the Constitution. That means the Department of Homeland Security can set enforcement priorities and can decide whom to deport.
Second, they say that providing relief to young undocumented immigrants and to the parents of U.S. citizen children is justified on humanitarian grounds.
The official said the action is predicated on a desire not to separate parents from kids who are lawful, and on an understanding that that’s a relationship Congress wants to respect.”
Fast forward to June 18th, 2020. The White House, arguing their authority to end DACA, lost in a 5-4 ruling. Not of the merits of their case but because of sloppy processing of the paperwork and procedures by AG Session’s Department Of Justice. The court in effect said, fix your paperwork, follow the procedures and you can come back, with a good chance of prevailing.
This has flared up the bases again but not all DACA recipients are against President Trump’s actions.

Dreamer, Trump supporter defends White House’s bid to end DACA in favor of broader reform
Hilario Yanez, a Dreamer who was brought to the country illegally as a toddler, told “Fox & Friends Weekend” on Sunday that he supports President Trump’s bid to end the Deferred Action for Childhood Arrivals[DACA] program in favor of broader reform, after a loss in the U.S. Supreme Court.
“I completely understand where the president is coming from,” Yanez said Sunday. “This is a president that’s all about rule of law, but also he is a compassionate leader.”
“I think… he is trying to force Congress to get back to work and do its job,” he continued, adding that “the only way we can really solve DACA is through legislative action, which would require a permanent solution for Dreamers in exchange for a border security package.” He stressed that would be “the best way forward.”
“Unfortunately the media has twisted this decision around against the president, to somehow believe that he’s trying to deport all these Dreamers. Instead, he’s trying to find solutions for the Dreamers,” Yanez said. “DACA is a winning issue for this president, for this election coming up.”
Yanez then said he thought Republicans and Democrats “can agree” that “there is a chance and opportunity for to us find a permanent solution.”
He said he hoped that by sharing his story, he could “try to change this narrative that somehow [Trump’s] trying to deport us, which is — it is not true.”
A political hot potato that will either end in a pathway to citizenship or the deportation of the DACA adults, with millions of other illegal aliens in the country. I am against the former but know that it is more likely than the latter will take place. Amnesty was a disaster for Reagan and America, we can’t afford for President Trump to do the same.
