On Friday, a federal judge shot down a request from Oregon’s AG to block federal agents from arresting people in the city of Portland as daily riots and demonstrations rock the city.
US District Judge Michael Mosman, a George W. Bush appointee, found that state Attorney General Ellen Rosenblum (D) lacked standing to sue the Department of Homeland Security (DHS) on the demonstrators’ behalf.
Mosman determined that Rosenblum failed to prove Oregon had an interest that was separate from those of private citizens and that the state relied on “purely hypothetical” arguments concerning the dangers facing Oregonians.
He also shot down the argument over the “chilling effect” on the speech rights of Oregon residents that Rosenblum cited, saying it was not a state-specific issue.
“Oregonians, like all Americans, have individual rights to freedom of speech and assembly, conferred by the First Amendment. They can, and often do, bring individual lawsuits to vindicate those rights. And the State of Oregon has not explained why this case is different, why the chilled speech it alleges here injures the state in a way that is distinct from the individual harms that it also alleges,” Mosman wrote.
Friday’s ruling was made just a day after U.S. District Judge Michael Simon, naturally an Obama appointee, issued a restraining order barring federal officers from arresting or using force against journalists and authorized observers at the demonstrations.
President Trump is catching a lot of flack from multiple Democrats who can’t stand it that the Commander in Chief is doing their job for them by sending in federal law enforcement agents who are protecting federal property and enforcing federal law in local jurisdictions.
They’re angry, because their collective plan was to make life so miserable for voters that they would turn on the president come the November election.
In the end, the American people are just going to remember how the Democrats allowed cities to burn and people to be killed and harmed.
Rosenblum’s lawsuit is yet another false argument that the federal government doesn’t have the authority to enforce federal laws or to protect federal property when mayors and governors fail to do so.
We already pointed out that the law stipulates that federal agents do not need permission from anyone to go into cities.
The federal government is sovereign to the states, and attorneys general like Rosenblum or just ignorant of the law, so they think they’re going to sue in court, and as usual get an Obama-appointed judge who will ignore the Constitution and rule in their favor. Well, Judge Mosman is not an Obama-appointed judge, so he knows and respects the law. Too bad, so sad, bye bye Rosenblum.
“I share the concerns of our state and local leaders – and our Oregon U.S. Senators and certain Congressional representatives – that the current escalation of fear and violence in downtown Portland is being driven by federal law enforcement tactics that are entirely unnecessary and out of character with the Oregon way.
These tactics must stop,” Rosenblum said in a statement announcing her lawsuit last week.
It’s a shame they don’t share the concerns about upholding the Constitution or share concerns for the people of Portland who aren’t happy with what’s happened to their city.
Democrats in Oregon are cowards who are violating the oath they took when elected by allowing the rule of law to be broken over the past 59 days of daily riots.
The Trump administration has adopted a tough stance on the protests, with President Trump calling the demonstrators “agitators and anarchists” and acting Homeland Safety Secretary Chad Wolf declaring that federal officials wouldn’t depart the city until “the violence stops.”
