On Wednesday, a Federal Judge denied a request for a preliminary injunction to let illegal aliens being held at a number of family immigration detention facilities to go free because of the Chinese virus pandemic.
Judge James Boasberg’s ruling in the US District Court for the District of Columbia, refused the request that the detainees be released as a result of the pandemic.
“Holding asylum seeking families in facilities with active [C-19] outbreaks or making them give up their kids to protect them is unconstitutionally punitive,” said Amy Maldonado, an attorney for the plaintiffs.
The judge wrote, “Petitioners, fearful as we all are of contracting a novel and dangerous disease, understandably swing for the fences in seeking wholesale release.” He continued, “Those fences are high and hard to clear, however, as Petitioners must demonstrate that no court-ordered remedy other than their release will do.”
The problem is we have a history and a vivid memory that whenever we release illegal aliens and give them a court date to show up for their hearing, they never show up and we’ve lost them forever. Democrats count on that, but this judge understands the rule of law and how much illegal immigration causes havoc on our society.
“The Preliminary Injunction Motion presents difficult legal questions and turns on disputed factual allegations about what is actually taking place inside the FRCs,” the judge noted. “At this point, however, the Court need not untangle those knots. Even assuming the conditions of Petitioners’ confinement violate their due-process rights, they have not yet clearly shown that they are entitled to the extraordinary remedy of blanket release from immigration detention. The Court will accordingly deny their Motion.”
Boasberg said that another federal court has ordered that minors who’ve been at the facilities more than 20 days should be released.
“Many Petitioners are minors who qualify,” he said. “As a practical matter, then, Petitioners’ request for release pertains principally to the adults among them.”
