You knew this was going to happen even as Joe Biden claimed he was against packing the Supreme Court. He has created a commission on reforming the Supreme Court.
One of the appointments to the commission is Caroline Fredrickson, the former president of the American Constitution Society. She is very vocal in her support for packing the Supreme Court. Other members are vague on what reforms they favor and have not said if they favor court-packing.
“I often point out to people who aren’t lawyers that the Supreme Court is not defined as ‘nine-person body’ in the Constitution, and it has changed size many times.”
Other members selected so far are Cristina Rodríguez, a Yale Law School professor and a former deputy assistant attorney general for Obama and Jack Goldsmith, a Harvard Law School professor, and a former assistant attorney general for George W Bush.
More members will be added as time goes on. What could possibly go wrong? Remember these are Democrats so we should be asking what could go right.
Speaking about the formation of the committee during his candidacy Biden said:
“It’s not about court-packing. There’s a number of other things that our constitutional scholars have debated and I’ve looked to see what recommendations that commission might make.’
“There’s a number of alternatives that go well beyond packing. The last thing we need to do is turn the Supreme Court into just a political football — whoever has the most votes gets whatever they want. Presidents come and go. Supreme Court justices stay for generations.”
Back in October when Biden announced his intentions to launch the commission. At the time he was embroiled in a battle as the press could not get him to answer if he would be for packing the court multiple times.
His silence is all the proof you need that he is willing to pack the court to keep them from striking down parts of his radical agenda.
A federal court has already ruled against him on his moratorium on deporting criminal illegal aliens.
