Joe Biden has ordered various departments of his administration to crack down on Texas over their Heartbeat anti-abortion bill. Biden also took his anger out on SCOTUS, claiming that the decision they made is unconstitutional. Biden is dead wrong. SCOTUS did not rule on the bill at all.
In fact, in the decision, they stated that in plain English. What they actually ruled was that they have to go through proper channels, whereas the Democrats insist that SCOTUS take the case out of turn.
Roe V Wade was not really decided on the reading of the US Constitution. That decision was based on shadows and clouds.
The far-left court that approved the decision could find nothing in the constitution that would allow them to rule, so they resorted to claiming the Constitution allowed for the decision because of hidden considerations.
At best, since the right to allow abortions is not an enumerated power given to the federal government, it is really up to every state to write its own laws.
Some states will allow abortions and some states won’t. Each state should have the right to make that decision for itself.
That’s the way the Founding Fathers wanted it. They did not want an all-powerful federal government dictating to the people except in certain areas such as national defense and interstate trade.
Biden said in a statement:

“The Supreme Court’s ruling overnight is an unprecedented assault on a woman’s constitutional rights under Roe v. Wade, which has been the law of the land for almost fifty years. While the Chief Justice was clear to stress that the action by the Supreme Court is not a final ruling on the future of Roe, the impact of last night’s decision will be immediate and requires an immediate response.”
“One reason I became the first president in history to create a Gender Policy Council was to be prepared to react to such assaults on women’s rights. Hence, I am directing that Council and the Office of the White House Counsel to launch a whole-of-government effort to respond to this decision, looking specifically to the Department of Health and Human Services and the Department of Justice to see what steps the Federal Government can take to ensure that women in Texas have access to safe and legal abortions as protected by Roe, and what legal tools we have to insulate women and providers from the impact of Texas’ bizarre scheme of outsourced enforcement to private parties.”
Biden does not have the right to punish a state because they pass a law he doesn’t like. But, then again, when did the law matter to a Democrat?
