Baltimore State Attorney will have to face criminal charges in court after a federal judge threw out a multitude of reasons Marilyn Mosby’s lawyers concocted, including the ever-popular racism. Mosby was indicted in January on charges of perjury and making a false statement on a loan application. Her lawyers argued that if the charges were not dismissed, the prosecutor, Assistant U.S. Attorney Leo Wise should be removed from the case.
U.S. District Judge Lydia Kay Griggsby refused to dismiss the case. She said that Mosby failed to meet the minimum standards for dismissing the case and she also refused to remove Wise from the prosecution. But here is the ironic part. Mosby claimed that Wise withheld exculpatory evidence from her lawyers. Mosby tried to convict six officers for the death of Freddie Gray. Those prosecutions failed for two reasons. The officers were not guilty and it was found that Mosby withheld exculpatory evidence.
WTOP reported:
“Bolden argued that Wise has a ‘penchant’ for prosecuting Black politicians and that he displayed animosity toward Mosby when he contributed $200 to her political opponents in 2018. He also alleged that Wise was belligerent in a meeting and that prosecutors failed to present potentially exculpatory evidence to a grand jury.”
Bolden claimed:
“We think these are powerful facts. We think you gotta do something about this. This is not a clean indictment.”
Mosby is accused of lying about being negatively impacted by COVID-19 and using the excuse to withdraw $40,000 from her Baltimore City retirement account, The Daily Wire previously reported. Prosecutors allege she did not face any financial hardship due to COVID-19 and that she allegedly used the money to purchase two properties in Florida. She is also charged with making false statements on mortgage applications, failing to note that she had unpaid federal taxes and that the IRS had placed a $45,000 lien against properties she and her husband owned.
But, of course she and her husband would not have unpaid federal taxes if it weren’t for the fact that they are black and the IRS computer had a racial animus against them.
But, the truth is Wise could not have brought charges against Mosby before it goes through a rigorous process and get approval from an internal “indictment review committee, and then it must go to a grand jury, and then, and only then could Wise bring charges.
