On Tuesday, U.S. District Court Judge Michael J. Newman issued a preliminary injunction halting illegal instructions given to the Border Patrol not allowing them to deport illegal aliens for any reason other than those who pose “public safety” or “national security threats” or who illegally crossed the U.S.-Mexico border after Nov. 1, 2020.
The rules, implemented by Homeland Security Secretary Alejandro Mayorkas were taken as an example of opening the border and giving a sort of amnesty to illegal aliens. Three states sued to end this policy. Those states are Ohio, Arizona, and Montana. The judge placed the injunction because he believed the states would win since the guidelines did not match up with immigration laws passed by Congress, which has jurisdiction in these matters.
This drastically cuts the number of deportations and allowed many illegals to remain in the country even though they broke our laws. In just a few short months the number of deportations dropped by 80% from 185,884 in the fiscal year 2020 to just 59,011 in fiscal 2021. Arrests are way down also at 36,619 administrative arrests compared to 123,128 the year before the COVID-19 pandemic. And it’s our tax dollars paying for their invasion into our country.
The judge cited his reasons for issuing the injunction which included the states would likely succeed in their case , failed to exercise “congressional intent, violated federal policymaking rules, and placed an unfair burden on state budgets.
Newman explained:
“The States sue because they believe DHS skirted Congress’s immigration enforcement mandates when it issued a policy that prioritizes certain high-risk noncitizens for apprehension and removal.”
“At bottom, that is what this dispute is about: can the Executive displace clear congressional command in the name of resource allocation and enforcement goals?” he continued, adding, “Here, the answer is no.”
In a statement on Twitter, Republican Arizona Attorney General Mark Brnovich celebrated the ruling.
“VICTORY: A federal judge just blocked the lawless Biden administration policy that halted nearly all deportations after our office challenged this guidance,” he wrote. “Our office has been at the forefront of the fights for the rule of law this past year. Arizona deserves nothing less.”
Ohio Attorney General Dave Yost added, “It’s amazing that we had to go to court to get an order for DHS to do its job, but that’s what it’s come to with this lawless administration.”
